Terms of Service

These terms cover your use of the Cohort Insights macOS application and this website. By installing or using the app, you agree to them.

Heads up. This is a fair, plain-English starting point — it is not legal advice. If you operate Cohort Insights in a jurisdiction with specific requirements, have a lawyer review and adapt these terms.

1. The agreement

These Terms of Service ("Terms") are an agreement between you and the makers of Cohort Insights ("we," "us," "our"). They govern your use of the Cohort Insights macOS application (the "App") and the cohortinsights.com website (the "Site"). If you do not agree to these Terms, do not install or use the App.

2. License

We grant you a personal, non-exclusive, non-transferable, revocable license to install and use the App on Apple devices you own or control, for your own use or that of your organization, subject to these Terms and any applicable Mac App Store terms.

3. Restrictions

You agree that you will not:

  • Reverse-engineer, decompile, or disassemble the App except as permitted by law.
  • Redistribute, sell, sublicense, or lease the App or any portion of it.
  • Use the App to violate Google's Analytics or API terms, or to access data you are not authorized to access.
  • Use the App in any manner that is unlawful, infringes the rights of others, or interferes with the operation of the App.

4. Your Google account

Cohort Insights requires you to authenticate with a Google account that has access to the Google Analytics 4 properties you want to view. You are responsible for maintaining the security of your Google account and for ensuring you have the right to view the data you access through the App. You can revoke the App's access at any time from your Google Account permissions page.

5. Third-party services

The App interoperates with Google services. Your use of Google Analytics and other Google services is governed by Google's terms and policies. We are not affiliated with, endorsed by, or sponsored by Google. "Google Analytics" and "GA4" are trademarks of Google LLC.

6. Updates

We may release updates to the App that fix bugs, change behavior, or add or remove features. Some updates may be required to keep working with Google's APIs. Updates are subject to these Terms.

7. Fees and refunds

If you purchase the App through the Mac App Store, all sales, billing, refunds, and cancellation requests are handled by Apple under their App Store terms. Direct-purchase or trial terms, if any, will be presented at the point of purchase.

8. Disclaimer of warranties

The App and Site are provided "as is" and "as available" without warranties of any kind, whether express, implied, or statutory, including without limitation warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the App will be error-free, uninterrupted, or that any reported analytics figures will be accurate or available at any given time.

9. Limitation of liability

To the maximum extent permitted by law, in no event will we be liable for any indirect, incidental, consequential, special, exemplary, or punitive damages, or for any loss of profits, data, business, or goodwill, arising out of or related to your use of the App or Site — even if we have been advised of the possibility of such damages. Our aggregate liability for any direct damages will not exceed the amount you paid us for the App in the twelve months preceding the claim, or US$50, whichever is greater.

10. Termination

You may stop using the App at any time by uninstalling it. We may suspend or terminate this license if you materially breach these Terms. Sections that by their nature should survive termination (including disclaimers, limitations of liability, and dispute provisions) will survive.

11. Changes to these Terms

We may update these Terms from time to time. When we do, we'll update the "Last updated" date above. Your continued use of the App after a change takes effect constitutes acceptance of the new Terms.

12. Governing law

These Terms are governed by the laws of the State of Texas, United States, without regard to its conflict-of-laws principles. You and we agree that the state and federal courts located in Harris County, Texas have exclusive jurisdiction over any dispute arising out of or relating to these Terms or the App, and you consent to personal jurisdiction and venue in those courts. Where mandatory consumer-protection laws of your country of residence apply, nothing in this section limits those rights.
